Terms of Service

1. 1. What DeBough does, and doesn't do

   DeBough reads settings on computers where you install DeBough Checkup, checks public information about domains you add, and shows the results with guidance. It observes and reports at a point in time. It is not antivirus, a firewall, a managed security service, a security audit, a certification, or legal, insurance, or compliance advice.

   Results can be incomplete or wrong, for example if a setting can't be read, a computer is offline, or something changes after a check. A good score means the checked items looked good when checked, nothing more. Nothing in the Service is a promise that your systems or data are free from risk or attack.

2. 2. Your account

   • You must be at least 18 and give accurate information.
   • Keep your password and sign-in codes private. You're responsible for activity on your account; tell us promptly about any misuse.
   • Enrollment codes and staff lesson links act like keys. Share them only with people who should have them.

3. 3. DeBough Checkup

   We grant you a limited, non-exclusive, non-transferable license to install DeBough Checkup on computers you own or are authorized to manage, for use with the Service. You may not sell, sublicense, or reverse engineer it except where the law allows.

   Checkup only reads settings; it does not change them. When connected to your dashboard it checks in on the schedule you choose and sends the results to your account. It updates itself automatically with versions signed by DeBough; by installing it you agree to these updates. You can disconnect or uninstall it at any time.

   Only install Checkup on computers you own or have permission to monitor, and tell the people who use those computers that it's installed. You're responsible for any notices or consents your local law requires.

4. 4. Your responsibilities

   • Use the Service only for your own organization, and only for lawful purposes.
   • Only add domains you own or manage, and only add people (for lessons) who work with you and whose contact details you may share with us.
   • Don't use the Service to probe, attack, or collect information about systems or people you aren't authorized to.
   • Don't try to break, overload, or get around the Service's security or limits.
   • You decide whether and how to act on anything the Service reports, and you're responsible for those actions, including any changes you make to your systems.

5. 5. AI features

   Some features use artificial intelligence to explain results, walk you through fixes, or draft answers (for example “Fix it with me,” email explanations, and questionnaire drafts). AI output can be inaccurate or incomplete. Check it before relying on it. Answers you send to insurers, clients, or anyone else are your responsibility, and DeBough never attests to anything on your behalf.

6. 6. Plans, trials, and payment

   • New accounts get a free trial. After it ends, some features require a paid plan. Current plans and prices are on our pricing page.
   • Paid plans renew automatically each month or year until cancelled. Payments are processed by Stripe; we don't store your card details.
   • On the Business plan, computers beyond the included number are billed per computer and adjusted as you add or remove them.
   • You can cancel anytime; your plan continues to the end of the period you've paid for. Except where the law requires, payments are non-refundable.
   • We may change prices with at least 30 days' notice before your next renewal.

7. 7. Your data

   You own the data you and your computers send to DeBough. You give us permission to store and process it to run, secure, and improve the Service, as described in our Privacy Policy. We don't sell your data.

8. 8. Suspension and ending the agreement

   You can stop using the Service and delete your account at any time by contacting us. We may suspend or end access if you break these terms, if payment fails and isn't fixed, or if needed to protect the Service or others. Sections that by their nature should continue (including 9 through 12) survive the end of this agreement.

9. 9. No warranties

   The Service is provided “as is” and “as available.” To the maximum extent permitted by law, DeBough disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or will detect every issue, or that your systems or data will be free from attack, loss, or breach.

10. 10. Limitation of liability

    To the maximum extent permitted by law: (a) DeBough will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, or any costs of a security incident, breach, ransomware, fraud, or downtime, even if advised they were possible; and (b) DeBough's total liability for all claims relating to the Service is limited to the greater of the amount you paid DeBough in the 12 months before the claim or fifty U.S. dollars ($50).

    Some places don't allow certain of these limits, so they apply only as far as your local law allows.

11. 11. Indemnity

    You agree to defend and hold DeBough harmless from claims, losses, and costs (including reasonable legal fees) arising from your misuse of the Service, installing Checkup on computers without authorization, or breaking these terms.

12. 12. General

    • These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts in Pima County, Arizona.
    • We may update these terms. If a change is significant, we'll tell account owners by email or in the dashboard before it takes effect. Continuing to use the Service after that means you accept the updated terms.
    • If any part of these terms can't be enforced, the rest still applies. Not enforcing a part isn't a waiver of it.
    • You may not transfer this agreement without our consent. We may transfer it to a successor, including a company we form to run DeBough.
    • These terms and our Privacy Policy are the whole agreement between us about the Service.
